December 15, 2022 Congrats to Max Grant, Charles Sanders, Greg Sobolski, Brett Sandford, Terra Reynolds, and the entire trial team from Latham & Watkins, LLP on their defense verdict in a patent case in Grand Rapids, MI on behalf of SMR. Although we stipulated to infringement prior to trial, the trial jury decided that the patents were invalid. I have always believed that you can win jury trials by out-preparing the other side, but these professionals, once again, took it to another level. This was a patent infringement trial between competitors involving some of the technology in e-cigarettes. Max is one of the best in the courtroom, having confidence, poise, and presence like few others can. And the Latham team was well-prepared and cohesive. May 18, 2021 Congrats to Jason Dennis, Greg Brassfield, and the entire trial team from Lynn, Pinker, Hurst & Schwegmann, LLP on their $3M jury verdict in Dallas in a dispute involving fiduciary duty and contract issues among family members. The emotional dynamics embedded in these cases, where family member are litigating, always presents an extra challenge for jurors to sort through in order to focus on what is fair. But there is always a key decision-driver, and it is no surprise that the professionals at LPHS were strategic in their approach, making it easy for this jury to get it right. Not only did the jury find no infringement by our client Irving Consumer Products, they also invalidated the patents asserted by the Plaintiff. The jury got it right because this team was well-prepared and skillful in the courtroom. It was a pleasure and a privilege to play a role in their success. December 13, 2021 Congrats to the trial teams from the Monsour Law Firm, the law firm of Aylstock, Witkin, Kreis & Overholtz, PLLC, and the Thomas J. Henry Law Firm on their $22.5M jury verdict in Federal Court in Tallahassee, FL against 3M. This was a bellwether case in the combat earplug MDL that resulted in the largest verdict of the 8 bellwether cases tried thus far. The Plaintiff was Thomas Finley, who is one of thousands of veterans who claim the 3M combat earplugs sold to the military were defective and caused hearing loss. It was a privilege and pleasure to play a role in their success story. This case involved race discrimination against General Dynamics/CSRA; and the jury, led by a school administrator, got it absolutely right as counsel stayed on message and hit the winning themes. October 27, 2021 Congrats to Andy Ryan of Ryan Law Partners, LLC, Josh Carlin of Hanson Curran, LLP and the entire Southwest Airlines trial team for their defense jury verdict in Rhode Island. This case was brought by 2 TSA employees over carbon monoxide exposure at the Providence airport. While the jury found the airport owner/operator negligent and awarded $26M, they got it completely right by deciding that Southwest was not negligent at all. Andy Ryan is a courtroom master who stuck to the trial themes and focused the jury on our key messages. On behalf of the Bloom team, it was a pleasure and privilege to play a role in this success story. October 22, 2021 Congrats to Josh Marks, DJ Goldfarb, and Elin Harrington from Berg Hill Greenleaf & Ruscitti, LLP on their defense jury verdict in Federal Court in Denver. This was a case involving a claim for excessive use of force by a police officer. This jury selection commanded an extra, and relatively, new layer of analysis due to politics. October 8, 2021 Congrats to Eric Buresh and his team from Erise IP, as well as Melissa Smith from Gillam & Smith, LLP on their defense verdict in a patent trial in Marshall, TX on behalf of Sony. This dispute involved patents on video game features, and the East Texas jury found no infringement and that the patents cover well-understood and routine technology, which paves the way toward invalidity. September 13, 2021 Congrats to Peter Prynkiewicz, Shawn Oller, and the entire team from Littler Mendelson, PC as well as Southwest Airlines on their defense verdict in an employment trial in Phoenix, AZ. This case involved claims of gender discrimination and retaliation by a female former employee. Interestingly, this unanimous verdict came from a jury comprised of 6 females and 1 male, demonstrating that demographics such as gender are not entirely predictive in jury selection. This patent case involved 2 life sciences patents for cancer testing; and the jury found they were infringed and awarded $4.7M. The jury also found willful infringement.
